LIMITED WARRANTY
Seller warrants this product to be free from defects in workmanship and materials, under normal use and conditions, for a period of one (1) year for the original invoice date.
Seller makes no express warranty or condition whether written or oral and Seller expressly disclaims all warranties and conditions not stated in this limited warranty.
For all transactions occurring in the United States, any implied warranty of condition of merchantability, satisfactory quality, or fitness for a particular purpose is limited to the duration of the express warranty set forth above.
Excluded from this warranty are the following:
Any imperfections in the inner foam layer of the product (“inside layer”), including but not limited to splits, cracks, and any variations in height/ thickness, and or visual appearance. These are a result of the production process and materials used and are not defects.
Any condition resulting from other than ordinary wear or any use for which the product was not intended, such as use in rental or contract trade or commercial use
Any condition resulting from incorrect or inadequate maintenance or care
Damage resulting from misuse, abuse, negligence, accidents or shipping damage
Dissatisfaction due to buyer’s remorse
Normal wear and tear
IN NO EVENT SHALL SOLO SKIFFS’ LIABILITY FOR ANY WARRANTY CLAIM HEREUNDER EXCEED THE AGGREGATE PURCHASE PRICE PAID BY CUSTOMER FOR ANY PRODUCT. THIS LIMITED WARRANTYEXCLUDES AND IN NO EVENT SHALL CRESCENT KAYAKS BE LIABLE FOR ANY EXTRAORDINARY, EXEMPLARY, SPECIAL, INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES OF ANY KIND, INCLUDING, LOSS OF USE, EVEN IF SOLO SKIFF K HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
